Alexandra Valiquette
Terms & Conditions
These terms create the practical boundaries around the website, Journal, programs, products and services—so expectations can remain clear before we begin.
The work may be personal, but the expectations should never be vague. These terms explain what you may expect and what is expected when you purchase, participate or use the material.
01
Acceptance, scope and eligibility
These Terms govern access to and use of www.alexandravaliquette.com and related pages or subdomains; The Whisper Journal; Aventures d’un monde anxieux; The Anxious Soul Whisperer; Here Again and other programs, memberships and digital resources; private and group coaching; retreats, workshops, speaking services and events; newsletters; downloads; audio and future physical products.
The website and services are operated by Alexandra Valiquette, carrying on business as Alexandra Valiquette Coaching.
By accessing the website, creating an account, submitting a form, purchasing, registering or using content, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website or purchase the services.
Eligibility
General educational content is intended for people aged 16 and older. You must ordinarily be at least 18 to make a purchase, enter a paid membership, receive coaching or enter another binding service agreement. A person under 18 may participate only where Alexandra Valiquette agrees in writing and a parent or legal guardian completes any required consent and service agreement.
02
Nature of the website and services
Educational and coaching purpose
Journal articles, newsletters, programs, recordings, workshops, resources and coaching are provided for education, reflection and personal development. They are not psychotherapy, psychiatry, crisis intervention, medical diagnosis or treatment, emergency support, legal advice, tax advice, investment advice or financial advice.
The website and services do not replace care from an appropriately licensed professional. You remain responsible for your health, choices, decisions and actions. In an emergency or where there is immediate danger, contact the appropriate emergency service in your location.
No professional-patient relationship through general content
Reading an article, subscribing to email, following social content or purchasing a self-guided resource does not create a medical, psychotherapeutic or professional-patient relationship. A coaching relationship begins only after the service is accepted, payment requirements are met, applicable agreements are completed and the arrangement is confirmed.
No guarantee of results
Personal growth and coaching outcomes vary. We do not guarantee the elimination of anxiety, a specific health or relationship result, employment, revenue, business growth or any particular personal outcome. Testimonials describe individual experiences and are not promises of the same result.
03
Purchases, billing and access
Prices and payment
Prices are shown in the currency identified on the sales or checkout page. Unless otherwise stated, offers are generally priced in U.S. dollars. You authorize the payment provider to charge the displayed amount and applicable taxes. Payments may be processed by Stripe, PayPal or another provider identified at checkout.
You are responsible for accurate billing information, authorization to use the payment method, reviewing the price and schedule, and paying applicable taxes, duties, conversion costs or bank fees.
Payment plans
A payment plan is a commitment to pay the full purchase price in scheduled instalments. It is not a cancel-anytime monthly subscription unless expressly stated. Failure to pay may lead to suspended access, cancellation of future sessions, collection of outstanding amounts or termination of participation. Stopping participation does not automatically cancel the payment-plan obligation except where required by law or agreed in writing.
Recurring memberships
A recurring membership renews automatically at the frequency and price disclosed at checkout until cancelled. You may cancel future renewals through available controls or by emailing admin@alexandravaliquette.com. Cancellation stops future billing but does not ordinarily create a prorated refund for the current period, except where required by law.
Digital products and licence
Digital products may include audio, journals, ebooks, worksheets, integration tools, templates, videos, courses and membership content. A purchase grants a limited, personal, revocable, non-exclusive and non-transferable licence for private use.
You may not share login credentials; copy, upload, reproduce, publish, resell or sublicense materials; distribute them to clients, employees, teams or groups; remove branding; create a competing product; or use protected materials to train an AI system, dataset or automated content generator without written permission.
Accounts
You are responsible for account credentials and activity through your account. Access may be suspended where an account appears to be shared, misused or compromised.
04
Refunds, appointments and events
Digital products
Because digital content may be delivered, streamed or downloaded immediately, digital products are final sale once access is delivered or content is accessed or downloaded, except where the relevant sales page provides a different written policy, we agree otherwise in writing, or a refund is required by law.
Coaching cancellations
Coaching appointments require at least 48 hours’ written notice to cancel or reschedule. A session cancelled with less than 48 hours’ notice may be considered used and forfeited. Missed appointments are forfeited and non-refundable.
A discretionary exception may be considered for a genuine emergency but is not guaranteed. If Alexandra Valiquette must cancel, the session will be rescheduled or an appropriate credit or refund will be provided. A more specific coaching agreement governs where it contains additional terms.
Retreats, workshops, speaking and events
These may have separate terms regarding deposits, deadlines, travel, accommodations, substitutions, insurance, force majeure and cancellation. Event-specific written terms govern. Travel documents, insurance, transportation and personal expenses remain the participant’s responsibility unless expressly included.
Physical products
Future printed journals, books or other physical products may have product-specific shipping, customs, delivery, return and damage-reporting rules presented on the product page or at checkout.
Chargebacks
Please contact us before initiating a chargeback so there is an opportunity to investigate. An unjustified chargeback may result in suspended access while reviewed. Nothing limits a lawful right to dispute an unauthorized or incorrect charge.
05
Programs, communities and conduct
Participants agree to communicate respectfully, protect others’ privacy, avoid harassment, threats, unauthorized recording, unsolicited promotion and impersonation, and avoid presenting themselves as representatives of Alexandra Valiquette.
A participant may be removed where conduct threatens safety, confidentiality or the integrity of the experience. Removal for serious misconduct may occur without a refund, subject to law.
Group confidentiality
Participants are asked to respect confidentiality, but another participant’s conduct cannot be guaranteed. Use discretion when sharing personal information in group calls, communities, retreats, workshops or comments.
Availability and changes
We may update content, modify delivery methods, schedule maintenance, replace platforms, adjust future prices or discontinue an offer. We do not guarantee uninterrupted or error-free access. Material changes to a purchased service will be handled reasonably and subject to applicable law.
06
Intellectual property and brand identity
Unless otherwise stated, the website, Journal, programs, materials, copy, photographs, graphics, audio, video, frameworks, downloads, design and other original content belong to Alexandra Valiquette or are used with permission.
Brand names and identifiers
Names and identifiers used in connection with the business—including Alexandra Valiquette, Alexandra Valiquette Coaching, The Anxious Soul Whisperer, The Whisper Journal, Aventures d’un monde anxieux, Here Again, and associated logos, slogans, program names, visual identities and frameworks—may function as trademarks, service marks or trade names to the extent protected by applicable law.
Nothing grants a licence to use those names or confusingly similar branding. The absence of a ™ or ® symbol does not waive rights. These Terms do not represent that every listed name is federally registered.
Permitted sharing
You may share a normal website link and a brief quotation with clear attribution. You may not reproduce an article, photograph, program, recording or substantial passage without written permission.
Prohibited use
You may not violate law or another person’s rights; impersonate a person; attempt unauthorized access; introduce malicious code; scrape or harvest data; send spam; misuse forms; distribute purchased materials; train an AI system on protected materials without permission; or engage in fraud, harassment or deception.
07
User content, testimonials and recordings
Feedback and testimonials
You retain ownership of original information you submit. By voluntarily submitting a review, testimonial or feedback for publication, you grant permission to use the approved material for website, editorial or marketing purposes within agreed limits. Sensitive coaching information will not be published as a testimonial without appropriate permission.
Comments, interviews and contributions
We may moderate, edit or remove content that violates these Terms, exposes private information, infringes rights, contains spam or creates a legal or safety concern. Submission does not guarantee publication.
Recordings
You may not record, photograph, transcribe, livestream, reproduce or distribute a coaching session, group call, retreat session or workshop without prior written permission. Where we plan to record, notice and required consent will be obtained.
Third-party services
Third-party services such as Systeme.io, Zoom, Stripe, PayPal and social platforms have their own terms and privacy practices. We do not control their availability or security.
Affiliate or sponsored content
The Journal or website may eventually contain affiliate links, sponsorships or paid collaborations. Commercial relationships will be disclosed where required. Editorial opinions remain our own.
08
Disclaimers, liability and termination
Disclaimer of warranties
To the fullest extent permitted by law, the website and general content are provided on an “as available” basis. We do not warrant uninterrupted access, correction of every error, suitability for every person or a particular result. Nothing excludes a consumer right that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Alexandra Valiquette will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of or inability to use the website, reliance on general content, third-party services, unauthorized access, business interruption, or loss of data, profit or opportunity.
For a paid product or service, aggregate liability will not exceed the amount paid for the specific product or service giving rise to the claim, except where prohibited by law.
Indemnity
To the extent permitted by law, you agree to be responsible for losses or claims arising from unlawful use, violation of these Terms, infringement of another person’s rights, content you submit or unauthorized distribution of protected materials.
Suspension and termination
Access may be suspended or terminated for non-payment, credential sharing, abusive conduct, confidentiality violations, intellectual property infringement, unlawful activity, security threats or material breach.
Force majeure
We are not responsible for delay or failure caused by events reasonably beyond our control, including severe weather, natural disaster, illness, travel disruption, platform or internet outage, government restriction, labour disruption, emergency conditions, war or terrorism.
09
Governing law and disputes
These Terms are governed by the laws of the Province of Québec and applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to mandatory consumer rights that apply in your place of residence, disputes will be submitted to a court of competent jurisdiction in Québec, Canada. Nothing deprives a consumer of a mandatory protection that cannot be waived.
Informal resolution
Before filing a claim, contact admin@alexandravaliquette.com with a written description of the concern and allow a reasonable opportunity to seek a practical resolution.
General provisions
If a provision is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, checkout terms and any specific written service agreement form the agreement governing the relevant service. A more specific signed agreement or checkout term controls in a direct conflict.
10
Changes and contact
These Terms may be updated to reflect changes in services, business practices or law. The updated version will be posted with a revised date and will apply prospectively unless otherwise permitted.
